Terms and Conditions

The terms and conditions detailed here apply to all transactions on Instant Pop Up Shelters™ . The placing of an order by any means and the use of this web site indicates your acceptance of these terms and conditions.
To use this site you must be at least 18 years of age.
Please note that these terms and conditions do not affect your statutory rights as a consumer.

Description of Goods

It is our intention to offer the most accurate information and image that is available to us however we cannot guarantee the reliability of the information contained on our pages.

Suitabilty

It is the responsibility of the individual user to ensure that goods they select and order are suitable for the purpose they intend to use them for. We may, at our discretion accept goods returned to us in these circumstances provided that they remain unopened, complete and unused. Goods accepted in these cases may be subject to a handling fee of up to 20%. It will be your responsibility to cover all carriage costs involved.

Guarantee

All goods purchased on our site are covered by the manufacturers 12 month warranty unless stated otherwise.

Payment

All prices quoted on our site are in £ sterling and exclude VAT at the current rate and. Payment can be made only by cheque or BACS.

Visitors in person to our works can pay using PDQ facilities by Credit/Debit card (excluding American Express) subject to authorisation. Due to fraud, we are unable to process Credit/Debit card transactions over the telephone/fax/letterat present until our secure server website is operational.

Orders can also be placed by phone/fax or by post.

You must provide us with your exact name, address and telephone number as incorrect information may lead to delays in shipping your goods.

Orders placed by cheque will be held until your cheque has cleared, which can take at least 10 days.

We will not be liable for delay and non-delivery on payments where payment has been refused or has not arrived.

Typographical Errors

Our range is constantly evolving and we endeavour to provide the most up to date information possible. If a product is incorrectly listed we reserve the
right to refuse or cancel any orders, whether or not the order has been confirmed.

Availability

All goods and services listed are subject to availability and may be withdrawn at any stage. We will not be responsible for any other losses you suffer as a result of the non-delivery of your order.

Deliveries

You will be responsible for goods as soon as we have delivered them to your door and you have signed for them. Do not sign for goods until you have examined them as courier responsibility ends with your signature. If you are unsure of the condition of your consignment do not accept it and contact us immediately.When you receive your order please check the condition of your goods and only sign for the consignment when you are happy with it. The responsibility of our couriers ends when you sign for your consignment and they will not accept claims for goods damaged in transit thereafter. If you have ordered large or heavy goods or live above ground level please ensure that you have someone available to assist our driver with the delivery.

Delivery Addresses

For security reasons we can only deliver to business premises and at the address of your order.

Delivery Charges

All prices quoted on www. Instant Pop Up Shelters™ . exclude delivery to the UK mainland which is available at an extra cost via our chosen courier service and will be made under normal conditions between the hours of 8am and 6pm weekdays.
Timed, Saturday AM and deliveries to offshore islands are available at an extra cost by phoning our customer service line.
The majority of deliveries are made from stock within 2-5 working days of payment. Items which are not in stock may take slightly longer but we will contact you with details. Deliveries of large and heavy items will require assistance and it will be your responsibility to provide this at delivery.Please note that we will not be liable for any costs, damages, charges or expenses caused by any delay in delivering goods that is beyond our reasonable control. In the event that your goods appear lost in transit please contact us immediately and we will attempt to rectify the situation.

Returns Policy

We do not offer Business Customers the right to cancel/return goods and this is not covered by the distance selling regulations.

Domestic Consumers will need to confirm it is for domestic use before placing an order as we only sell to the trade/businness users.

Time Limit for Notification of Claims

Damaged Goods: If your goods arrive damaged do not sign for your consignment and contact us immediately. If the damage is not immediately apparent you must inform us within 3 days and keep all packaging to support your claim.

Shortages: It is your responsibility to sign for the correct number of packages as shown on the delivery consignment note. Any shortages must be notified to us within 3 days of delivery.

Incorrect Goods: It is your responsibility to inform us of any incorrect goods supplied within 3 days of delivery.

Damaged and Shortage at time of delivery

In the unlikely event that your order is received damaged please contact us immediately and at the latest within 3 working days.
In order to ensure a safe return it is essential that you use the original packaging or its equivalent as couriers may refuse to collect goods they consider to be insufficiently packaged and this may affect any warranty if the goods become damaged in transit.
(a) Where goods are delivered by outside carriers, damage or part loss claims cannot be entertained unless the carriers and the Company are notified in writing within three days of the date of delivery.
(b) Where goods are delivered by the Company and a receipt of delivery note signed by the Customer is received, the goods will be deemed to have been examined and therefore no claim for damage or loss made by the Customer can be entertained by the Company. The Customer may not exclude this provision either by marking his signature “unexamined” or by failing to return the signed delivery note or otherwise.
(c) In the case of a damage claim under warranty, the goods must be returned to this Companies premises for inspection before being dealt with.

Warranty

The Company’s liability for replacing goods which have proved to the Company’s reasonable satisfaction to be defective under careful use because of defective materials, whether used by the Company, its associates or suppliers, or because of faulty workmanship of the Company’s employees before and during the twelve calendar months from the date of supply, is limited to replacing such goods free of charge. Any such replacement is subject to the Customer notifying the Company of the defect in writing within 12 months from the date of supply, and subject to the Customer not having attempted to repair the goods himself or in any way interfered with the goods.
The provisions of section 12 of the Sale of Goods Act 1893 shall apply to this Contract, but this guarantee is given in lieu of all other warranties conditions and obligations imposed or applied by statute or otherwise, and in particular , without prejudice to the generally of the foregoing, the Company shall not be liable for loss of profit or goodwill of the buyer or any other person arising or indirectly from any breach of this Contract or for any other indirect or consequential damage whatsoever.
No claim under this guarantee by the buyer shall be a basis for rescinding the Contract or withholding payment of any sum due to the Company under this or any other contract.

This does not apply to faults caused by accident, misuse or neglect - in these cases no repair will be carried out. You will be liable for all carriage costs involved in these cases.

In the event that your purchase develops a fault after 28 days and within its 12 month guarantee we will arrange to collect, repair and return it to you free of charge. . This does not apply to faults caused by accident, misuse or neglect - in these cases no repair will be carried out and the goods will be
returned to you. You will be liable for all carriage costs involved in these cases. This does not affect your statutory rights.

Data Protection Act

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).
We will collect information about you for 2 reasons: Firstly, to process your order and secondly, to provide you with the best possible service.

We will remove you from our email lists if you request us to do so either by automatic service or by email to our customer service dept.
We will not pass your email address to other trusted traders unless you agree.

The type of information we will collect about you includes your:

Name
Address
Phone Number
Email Address
Credit/Debit card details.

We will never collect sensitive information about you without you explicit consent.
The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.
The personal information that we hold will be held securely in accordance with our internal security policy and the law.
We may use technology to track the behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.
